BNB Advocates advises the Government of Uganda on the development of the Climate Change Bill

BNB Advocates has been contracted by the Government of Uganda through the Ministry of Water & Environment to advise on the development of the Climate Change Bill, and will undertake the following activities in a contract expected to last 6 months:

  • Undertake a Regulatory Impact Assessment (RIA) on the proposed Climate Change Bill.
  • Undertake a deep analytical assessment of the existing climate change related laws, policies, strategies, institutional arrangements and relevant international/regional treaties/protocols.
  • Identify the gaps and weaknesses of the existing legal, policy, and institutional framework in relation to climate change in Uganda, and specifically related to the implementation of the Climate Change Policy and Implementation Strategy.
  • Facilitate (plan, lead, and undertake post-event follow-up) stakeholder consultations on the development of the Climate Change Bill while building public trust and confidence in the process and ensuring the generation of consensus on contentious issues.
  • Make detailed written proposals and recommendations for addressing any observed gaps and weaknesses in the legal, policy, and institutional framework and incorporate relevant feedback/input from stakeholders.
  • Draft a Climate Change Bill for implementing the Climate Change Policy in Uganda. Ensure that the Climate Change Bill is effectively linked with other existing laws, including but not limited to the National Environment Act.

BNB Advocates advises the Government of Uganda on the Preparation of REDD+ Strategy for Uganda’s National REDD+ Programme.

BNB Advocates has been contracted by Oy Arbonaut Ltd, Finland to act as legal expert and advise the Government of Uganda through the Ministry of Water & Environment in the preparation of REDD+ Strategy for Uganda’s National REDD+ Programme. BNB Advocates will be responsible for the delivery of the following tasks:

  • Analysis of the policy, legal, regulatory and institutional framework relevant to REDD+ in Uganda.
  • Comprehensive assessment of the identified REDD+ strategic options for their feasibility in terms of: political and institutional perspective; policy, legal and regulatory implications.
  • Participation in consultative meetings to ensure legal and policy aspects are properly consulted on, participation in field workshops, review and provide inputs into the consultations reports.
  • Support the team in preparation and submission of the National REDD+ Strategy that: meets the requirements of the UNFCCC; and related MEAs; meets the requirements for government of Uganda implementing ministries’ sector planning and budgeting formats; meets the requirements for key multilateral, convention, bilateral, and other international funds

BNB Advocates advises the Government of Uganda on the development of Principles for the Climate Change Bill.

BNB Advocates will be responsible for the delivery of the following tasks:
  • To undertake comprehensive literature review on the development of the Climate Change Bill.
  • To carry out consultations of key stakeholders in Uganda on the development of the Climate Change Bill.
  • To develop principles for the enactment of the Climate Change Bill.
  • To compile a final report on the assignment containing a cabinet memorandum of principles for the enactment of the Climate Change Bill ready for presentation to cabinet.

BNB Advocates advises the Advocates Coalition for Development and Environment (ACODE), in a contract with the Government of Uganda concerning a study ‘Strengthening National Feedback and Grievance Redress Mechanism (FGRM) for Uganda’s REDD+ Programme.

BNB Advocates will be responsible for the delivery of the following tasks:
  • Undertake an assessment of the capacity of local and national institutions to address REDD+ related grievances, including identifying strengths and gaps of the said institutional framework;
  • develop principles, procedures, structure and functions of the Feedback and Grievance Redress Mechanism for REDD+ in Uganda;
  • make proposals on possible elements and options for grievance redress mechanisms (GRM) during readiness activities and those required during REDD+ Implementation;
  • carry out a comprehensive review and analysis of the international laws and guidelines related to REDD+ and the Feedback and Grievance Redress Mechanism (FGRM);
  • carry out a comprehensive review and analysis of the legal, policy, and regulatory framework related to REDD+ in Uganda, including assessment of the gaps and bottlenecks in the said framework that may lead to the emergence of conflicts during REDD+ implementation;
  • formulate recommendations for strengthening policy, legal and institutional framework for managing grievances and conflicts that may arise during REDD+ implementation;
  • propose options for establishing an appeals process that REDD+ stakeholders can use if they are not satisfied with how their grievance has been resolved;
  • organize and conduct field work and case studies so as to develop a deeper understanding of existing and future conflicts related to REDD+; organize and conduct consultations with key stakeholders and policy makers;
  • develop all technical documents and reports required by the Ministry of Water & Environment, including the following: Work Plan; Inception Report; draft & final Process Reports; draft & final Consultancy Reports;
  • organize and participate in all meetings relating to the assignment including, meetings of the National Technical Committee, Taskforce, the client, the World Bank, and other stakeholders; undertake workshops to discuss the draft report; and the validation workshop.
